Company _________________, hereinafter to as The Shipowner, in presence of ___________, on the one hand, and Ukrainian firm _______________ (Ukraine), hereinafter as The Charterer, in presence of ____________, on the other hand, have concluded the present contract on the following.
1. SUBJECT OF THE CONTRACT
The Shipowner shall lease and The Charterer shall accept into demise-charter, without right to sale, under the terms of the present contract the fishing vessel type M/V, named _______________ with the right to control the crew, for the period of 2 (two) years for catching, processing, transporting of sea products without restriction of sailing area.
2. OBLIGATIONS OF PARTIES
2.1. The Shipowner shall:
give to demise-charter the aforementioned vessel in good technical condition with prepared valid Register documents which give to the vessel the right to work at sea during all the period of rent;
guarantee the recruitment of the crew on terms agreed with The Charterer;
process without delay all the essential documents concerning the fulfillment of agreed obligations;
carry the expenses for the repair between voyages, the radio communication with The Shipowner, port duties;
The Shipowner shall reserve the right to exercise the continuous control of technical exploitation of the vessel, the observance of the International Conventions standards and rules and sailing safety.
2.2. The Charterer shall:
use the vessel in accordance of its technical function;
carry at his own expenses all the operational expenses (fuel, water, crew nutrition, import duties etc.);
guarantee the operation of the vessel without breakdowns and the safety of rented property;
finance the expenses for technical exploitation, repair in docks, except the operations connected with the liquidation of breakdown of technical equipment of the vessel caused by natural physical wear, fault of crew or third party;
exploit aboard the vessel the skilled crew with the correctly processed documents;
effect in time the payments for rent determined by the present contract and payment for the exploitment of the vessel in areas of other states.
2.3. The parties shall provide each other with assistance in solving difficult questions which arise in the course of fulfillment of obligations according to the contract on mutually beneficial terms.
